Notification No. 17509 dated 18 October 2016 on the Commencement of the Implementation of Tax Service Agents

On 18 October 2016 the General Department of Taxation (“GDT”) issued Notification No. 17509 on the Commencement of the Implementation of Tax Service Agents (“Notification No. 17509”). According to Notification No. 17509, the GDT has issued tax service licenses (“Tax License”) to 34 companies, the names of which are attached to the Notification. The purpose of Notification No. 17509 is to inform the public of those companies that have been granted such a Tax License in advance of 1 January 2017. From that date, those who have not obtained a Tax License will be prohibited from performing a number of functions relating to a taxpayer’s obligation under the Law on Taxation (“LOT”).
Obversely, from 1 January 2017, only those granted a Tax License (a so-called “Tax Service Agent”) will be permitted to communicate or fulfill tax obligations of behalf of a third party taxpayer. Companies and individuals will still be allowed to fulfill their own tax obligations but cannot do so for others without first obtaining a Tax License. Those who do provide tax services for others without a Tax License will be committing obstruction which, pursuant to Articles 128 and 136 of the LOT, carries a criminal penalty of between KHR 5million-10million (approximately USD 1,250-2,500).
The GDT has urged all enterprises who are currently providing or wish to provide the services of a tax service agent to apply for the applicable Tax Licenses as soon as possible.
